Part A – General terms and conditions for the use of the website and services of MyGU GmbH (i.e. applies to all services)

1. Scope of application

1.1.These General Terms and Conditions for the Use of the Internet Site and Services of MyGU GmbH govern the contractual relationship between a consumer or entrepreneur and MyGU GmbH, irrespective of which services the user makes use of from MyGU GmbH. These General Terms and Conditions apply accordingly to contracts for the sale and delivery of vouchers, insofar as nothing to the contrary has been expressly regulated. MyGU GmbH is also referred to as MyGU in the following conditions.

1.2.With regard to the use of individual services, special conditions may apply in addition to these General Terms and Conditions for the use of the service (cf. Part B). In the event of a contradiction, the provision in the Special Conditions for the Use of the respective Service takes precedence over these General Conditions. When each individual service is ordered, to which Special Terms and Conditions apply in addition, an individual contract is concluded.

1.3.The General Terms and Conditions and any additional Special Terms and Conditions for the use of individual services are hereinafter referred to collectively as "GTC".

1.4.A consumer in the sense of these GTC is any natural person who concludes a legal transaction for purposes which can predominantly neither be attributed to his commercial nor his self-employed professional activity. Entrepreneur in the sense of these GTC is a natural or legal person or a partnership with legal capacity, which acts in the exercise of its commercial or independent professional activity when concluding a legal transaction.

2. Type of services

2.1.The object of MyGU is to provide advice and mediation in the field of international Students at German universities, advising German universities with regard to study offers especially for students from abroad as well as carrying out corresponding marketing activities, arranging services for international students in connection with taking up studies in Germany as well as operating a corresponding Internet portal.

2.2.MyGU's website provides users with a wealth of information about studying in Germany and the application procedures for studying in Germany. In addition, individual fee-based services can be booked within the website, which provide in-depth information and/or individual advice on the above-mentioned topics.

3. Conclusion of contract

3.1.The possibility of using the services offered on the MyGU website does not constitute an offer, but merely an invitation by the user to submit an offer. The booking of services on the MyGU website is only possible after creating a free individual user account. By completing the booking process, the user submits an offer to conclude the contract for the use of a service. MyGU does not accept this offer to provide a service already by confirming receipt, but only by confirming the order or otherwise by providing the corresponding services. The contract between the user and MyGU is only concluded through this acceptance. MyGU is not obliged to conclude a contract. Insofar as services against payment are concerned, the user accepts the corresponding payment obligation by clicking on the confirmation field.

3.2.The contract is concluded with MyGU GmbH, ℅ Steinstraße 5-7, 20095 Hamburg, Germany. Further contact data, commercial register data and the name of a person authorized to represent MyGU GmbH can be found in the imprint.

3.3.The user can submit the offer exclusively via the online order form integrated into the MyGU website. After placing the selected services in the virtual shopping basket and completing the electronic ordering process, the customer submits a legally binding contractual offer with regard to the goods contained in the shopping basket by clicking the button completing the ordering process.

3.4.To participate in an online information event (webinar, meeting) or to book a paid service (e.g. the Academy courses), it is technically necessary to create a free user account.

3.5.When submitting an offer via the online order form, the contract text is saved by MyGU after the conclusion of the contract and made available to the user in text form via email. In addition, the user is informed of his order data by email.

3.6.Before binding submission of the order via the MyGU online order form, the user can recognise possible input errors by attentively reading the information displayed on the screen. An effective technical means for better recognition of input errors can be the enlargement function of the browser, with the help of which the display on the screen is enlarged. Within the framework of the electronic ordering process, the user can correct his entries using the usual keyboard and mouse functions until he clicks on the button at the end of the ordering process.

3.7.The German and English languages are available for the conclusion of the contract.

4.Terms of use for the website

4.1.The user commits himself,

  1. to give only true information about his identity, his personal circumstances and his school-leaving qualifications and diplomas, including the related details (grades, place of study, etc.)

  2. to observe applicable law including the rights of third parties and therefore in particular to use or make accessible data, illustrations or contents that are not legally protected (e.g. by trademark or copyright law)

  3. Not to distribute or publicly reproduce the contents of the MyGU website or of other users, unless such distribution and public reproduction is provided for within the scope of the respective MyGU offer or service or the other user has agreed to such distribution and public reproduction.

4.2. With regard to the user account on the MyGU website, the user undertakes to keep his password secret and not to pass it on to third parties.

4.3. By creating a free account, the user agrees to receive information by e-mail about the services of MyGU as well as study programs, universities and partners linked on the website. The user can unsubscribe from these notifications at any time in his/her notification settings. 

4.4.If the user requests information from a university or partner via a so-called lead form, the user consents to the transfer of data to the named third party and to its terms and conditions and privacy policy.

5. Change of services and general terms and conditions

5.1.MyGU reserves the right to change the services offered on its website, unless this is unreasonable for the user.

5.2.In addition, MyGU reserves the right to change the services offered on its website if

  1. MyGU is obliged to ensure that the services it offers comply with the law applicable to the services; this applies in particular if the applicable legal situation changes.

  2. MyGU follows and implements judicial or official decisions with the amendment

  3. this is necessary to close technical security gaps

  4. the change is only beneficial to the user or has no material effect on the user.

5.3.MyGU reserves the right to change these GTC at any time without stating reasons, unless this is unreasonable for the user. MyGU will inform the user of changes to the GTC in good time. If the user does not object to the validity of the new GTC within six (6) weeks of notification, the amended GTC shall be deemed to have been accepted by the user. MyGU will inform the user in the notification of his right to object and the significance of the objection period.

5.4.MyGU may also amend the GTC in this case,

  1. if the change is only advantageous for the user

  2. if the change is purely technical and does not have any material effect on the user

  3. MyGU by the change the conformity of the AGB with applicable right to manufacture, in particular if the valid legal situation changes;

  4. in order to comply with a court or administrative decision; or

  5. if MyGU introduces additional, completely new services or service elements that require a service description in the GTC and the previous user relationship does not change disadvantageously for the user.

MyGU will inform about such changes to its GTC on its website.

6. Termination

6.1.The free user account can be terminated by the user or by MyGU at any time with one week's notice. The statutory provisions shall apply to the termination of a specially agreed, chargeable service.

6.2.In addition, both parties may terminate the user account or the specially agreed, chargeable services for good cause without notice. An important reason is if the continuation of the contractual relationship until the end of the statutory period for the terminating party in the circumstances of the individual case and weighing the interests of both parties is not reasonable. An important reason for MyGU exists in particular if the user behaves in violation of the law or the contract.

6.3.The user's claim to repayment of fees already paid in advance in the event of termination is excluded, unless the user terminates the contract for an important reason for which MyGU is responsible.

7. Right of withdrawal

7.1.Consumers are generally entitled to a right of withdrawal. A consumer is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to his commercial nor to his independent professional activity.

7.2.Consumers have the right to revoke this contract within fourteen days without giving any reason. The revocation period is fourteen days from the day of the conclusion of the contract. In order to exercise the right of withdrawal, the consumer must inform MyGU GmbH (℅ Beehive, Steinstr. 5-7, 20095 Hamburg, [email protected]) by means of a clear declaration (e.g. a letter or e-mail sent by post) of his decision to withdraw from this contract. For this purpose, the consumer may use the following sample revocation text (with indication of the personal data to be supplemented).

  • I/we (*) hereby revoke the contract concluded by me/us (*) for the purchase of the following goods (*)/the provision of the following service (*).

  • Ordered on (*)/received on (*)

  • Name of the consumer(s)

  • Address of the consumer(s)

  • Signature of consumer(s) (only in case of paper communication)

  • Date

(*) Delete where inapplicable.

To comply with the withdrawal period, it is sufficient to send the notification of exercise of the right of withdrawal before the expiry of the withdrawal period.

7.3.Consequences of revocation: In the event of revocation, MyGU shall refund to the consumer all payments made by the consumer for the said contract without undue delay and at the latest within fourteen days from the day on which the notification of the user's revocation of this contract was received. For this repayment, MyGU shall use the same means of payment that the consumer used in the original transaction - unless expressly agreed otherwise with the consumer; in no case shall the consumer be charged any fees because of this repayment. If the consumer has requested that the services begin during the withdrawal period, he shall pay MyGU a reasonable amount corresponding to the proportion of the services already provided up to the time the consumer notifies MyGU of the exercise of the right of withdrawal with regard to this contract, compared to the total scope of the services provided for in the contract.

7.4.MyGU may ask the consumer to agree to the exclusion of the right of withdrawal prior to the commissioning of services, provided that the provision of services takes place in full or in part within the aforementioned withdrawal period. The consumer may therefore be asked to make the following statement: "I agree and expressly request that MyGU commence the performance of the commissioned service before the end of the withdrawal period. I am aware that I lose my right of withdrawal upon complete fulfillment of the contract."

8. Prices and terms of payment

8.1. Unless otherwise stated in the description of the MyGU service, the prices quoted are total prices which include statutory value-added tax.

8.2. Payments to MyGU by the user are exclusively made through the use of the payment service Unzer (Unzer E-Com GmbH, Vangerowstraße 18, 69115 Heidelberg, Germany, Amtsgericht Mannheim, HRB 729719). The terms of use of Unzer apply (https://www.unzer.com/en).  Unzer offers various cashless payment options (credit card, Paypal, etc.). Unzer reserves the right to check the creditworthiness of the user and to exclude individual payment options in individual cases or for individual countries.

9. Liability

9.1. MyGU is liable in accordance with the statutory provisions for damages resulting from injury to life, body or health which are based on a breach of duty by MyGU, a legal representative or vicarious agent of MyGU as well as for damages which were caused by the absence of a quality guaranteed by MyGU or in the case of malicious conduct by MyGU. Furthermore, MyGU shall be liable without limitation for damages caused intentionally or through gross negligence by MyGU or one of its legal representatives or vicarious agents.

9.2. Apart from that, MyGU excludes any liability for the accuracy of the information provided on the website, in emails, courses, webinars or other media and is also not liable in case of misinformation. 

10. Force majeure / technical problems

10.1. In the cases in which the user cannot use a chargeable service agreed at a certain date for reasons of force majeure or other reasons for which neither the user nor MyGU is responsible, both parties undertake to agree a new date for the use of the chargeable service.

 

10.2. The same regulation applies to cases in which the user or MyGU cannot call up or provide the chargeable service due to temporary technical problems (e.g. with the establishment of an Internet connection). If the technical problem persists even at the new date, both parties may terminate the contract for the provision of the service without notice.

11. Property rights and copyrights

The MyGU website and the underlying program code, in particular the study program database ("StudyFinder"), the subject articles ("Articles"), the webinars and Academy courses, as well as components thereof, are subject to industrial property rights and are protected by copyright. MyGU is the exclusive owner of all copyrights or the owner of corresponding exclusive rights of use to all works used. This includes, but is not limited to, all images, videos, films, texts, databases and applications. Use of these works is not permitted without the express consent of the provider, which must always be given in writing.

12. Data protection

12.1. A collection and processing of personal data only takes place if the user has consented or this is permitted by law. The collection and processing of personal data on the basis of legal permission is carried out in particular in connection with MyGU's fulfilment of contractual obligations towards the user.

13. Applicable law

13.1. All legal relationships between the parties shall be governed by the laws of the Federal Republic of Germany to the exclusion of the laws governing the international sale of movable goods. In the case of consumers, this choice of law shall only apply insofar as the protection granted is not withdrawn by mandatory provisions of the law of the country in which the consumer has his habitual residence.

13.2. Furthermore, this choice of law does not apply to consumers who do not belong to a member state of the European Union at the time the contract is concluded and whose sole place of residence and delivery address are outside the European Union at the time the contract is concluded.

14. Legal age

The user assures MyGU that he is of legal age according to the applicable law for the use of the website and the services of MyGU, but at least according to German law. Upon MyGU's request, the user must prove that he is of age.

15. Alternative dispute resolution

15.1. The EU Commission provides a platform for online dispute resolution on the Internet at the following link: https://ec.europa.eu/consumers/odr This platform serves as a contact point for out-of-court settlement of disputes arising from online sales or service contracts in which a consumer is involved.

15.2. MyGU is neither obliged nor willing to participate in a dispute resolution procedure before a consumer mediation body.
 

Part B) Specific conditions for each service

1. The MyGermanUniversity (browser-based) Application

The MyGU website (www.MyGermanUniversity.com) comprises a variety of static and dynamic content, which in its entirety is referred to as a web-based application. It includes, among other things, the study program database ("StudyFinder") and the Academy courses. 

1.1. Scope 

The MyGermanUniversity Application is provided for the purpose of helping the user in finding available study programs on the basis of the criteria he entered, guiding him through the whole mobility process, from checking the eligibility and preparing the application until starting the studies in Germany (collectively, the “App” or „MyGermanUniversity“ as described herein or afterwards).

MyGermanUniversity provides the user with a database of universities and study programs (called “StudyFinder”) by presenting own data as well as third party data, such as universities and study programs (e.g. general information, application criteria and deadlines or links to the website of the respective university or study program) or social media platforms (e.g. Instagram or Facebook). In any case, such selection remains at all times a mere suggestion without any claim to be accurate, exhaustive or to be understood as an actual recommendation suiting the user's personal and educational needs. Further, MyGermanUniversity offers courses that prepare for the University application (cf. B2). The features of the App described herein are not exhaustive. The Company reserves the right at any time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice.

1.2. Registration and creating an account

1.2.1. In order to use the App the user must create a user account, either by entering his name, surname and email address or by using the user's Facebook or Google Login in the relevant plugins. When and if the user register, the user agree to 

  1. provide accurate, current and complete information about himself as prompted by the registration form and 

  2. maintain and update the user's information (including the email address) to keep it at all times accurate, current and complete.  

The user acknowledges that, if any information provided by him (or on his behalf, under his direction or knowledge) is untrue, inaccurate, not current or incomplete or contains a misrepresentation, MyGU reserves the right to immediately terminate this Agreement and the user’s access and use of the Service without further notice.

1.2.2. If the user creates his user account by using seines Facebook-Login, he authorizes MyGU to access and use certain information from his Facebook account, including the user's public Facebook profile. However, MyGU will separately ask for the user’s permission during the registration process. MYGU WILL NOT BE ABLE TO POST ON FACEBOOK FOR THE USER AND WILL ONLY USE THE DATA FOR WHICH MYGU CLEARLY ASKS FOR THE PERMISSION IN THE STATED WAY AND EXTENT AND WHICH MYGU DEEMS NECESSARY FOR THE PROVISION OF ITS SERVICES.

1.2.3. As part of the registration process, the user will be asked to answer several questions, which MyGU deems necessary in order to provide the user with personalized information (e.g. Application deadlines, Tuition fees) and selected information on available study programs and universities. Further, the user will be asked to select a password. the user will be responsible for the confidentiality and use of the user's password and agree not to transfer or resell the user's use of or access to the Service to any third party. If the user have reason to believe that the user's account with us is no longer secure, the user must promptly notify MyGermanUniversity by sending an email to [email protected]. the user ARE ENTIRELY RESPONSIBLE FOR MAINTAINING THE CONFIDENTIALITY OF the user's USERNAME AND PASSWORD AT ALL TIMES AND FOR ANY AND ALL ACTIVITIES CONDUCTED THROUGH the user's ACCOUNT.

1.3. Provided information

1.3.1. The purpose of the MyGermanUniversity App is to provide the user with useful information about universities and study programs in Germany, help the user to apply and get admission into selected universities of the user's choice and guide the user through the whole student mobility process. For this purpose, MyGermanUniversity also uses and provides third party data, including, but not limited to, Facebook and Instagram, the respective university's or study program's websites or Google Maps.

1.3.2. The App is for personal use only. Users may not use MyGermanUniversity or any content contained in or distributed via the App (including, but not limited to, content of study programs, designs, text, graphics, photos, images, videos, information, logos, software, audio files and computer code) in connection with any commercial endeavours. Organisations, companies and/or businesses may not use the Service for any commercial purpose except with MyGU‘s express consent and under separate commercial agreements entered into with MyGU (such as for targeted advertising or other advertisements), which MyGU may provide or deny in its sole discretion. MyGU may investigate and take any available legal action in response to any illegal and/or unauthorised uses of the App, including scraping any database or website content, collecting usernames and/or email addresses of users by electronic or other means for the purpose of sending unsolicited emails and unauthorised framing of or linking to the App.

1.3.3. The Service may contain links to other Internet websites, including affiliated websites which may or may not be owned or operated by MyGU. MyGU has not reviewed the websites that are or may be linked to from or via the Service, and the Company has no control whatsoever over such websites. MyGU is not responsible for the content of such websites, any updates or changes to such sites, or the privacy or other practices of such sites, and the fact that MyGU offers such links does not indicate any approval or endorsement of any material or content contained on any linked site. MyGU is providing these links to the user only as a convenience.THE EXISTENCE OF LINKS TO EXTERNAL WEBSITES DOES NOT MEAN THAT MYGU ENDORSES OR PROMOTE THOSE WEBSITES, THE PROVIDED INFORMATION, PRODUCTS OR SERVICES AVAILABLE ON SUCH WEBSITES OR THE VIEWS OF THEIR DEVELOPERS, OWNERS, MEMBERS, PRODUCTS OR SERVICES. MYGU HAVE NO CONTROL OVER THE CONTENT OF THOSE EXTERNAL WEBSITES OR OTHER THIRD PARTY RESOURCES, AND ACCEPT NO RESPONSIBILITY FOR AND EXCLUDE ALL LIABILITY THAT MAY ARISE WITH RESPECT TO THEM OR FOR ANY LOSS OR DAMAGE THAT MAY ARISE FROM the user's USE OF THEM.

1.3.4. ANY CONTENT, SUGGESTION PROVIDED THROUGH THE MyGermanUniversity APP IS PROVIDED "AS IS" AND WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. MYGU IS NOT RESPONSIBLE IN ANY WAY FOR ANY CONTENT, SUGGESTION OR DATA PROVIDED TO THE USER THROUGH ITS SERVICE, IRRESPECTIVE OF WHETHER OWN DATA OF MyGU OR THIRD PARTY DATA. MyGU IS FURTHER NOT LIABLE FOR THE CORRECTNESS, COMPLETENESS OR ACCURACY OF THE PROVIDED INFORMATION (SUCH AS BUT NOT RESTRICTED TO: UNIVERSITY AND STUDY PROGRAM NAMES, DURATION, STUDY FEES, APPLICATION PROCEDURE, APPLICATION DEADLINES, DESCRIPTIONS OF PROGRAMS, ETC.). THIS INFORMATION IS SUPPLIED WITHOUT LIABILITY AND THE USER ACKNOWLEDGES THAT HE SHALL NOT BE ENTITLED TO CLAIM FOR DAMAGES DIRECTLY OR INDIRECTLY CONNECTED TO THE USE OF THE SERVICE. IT IS THE USER’S RESPONSIBILITY TO REGULARLY CHECK FOR UPDATES OR CHANGES IN THE DATASET DIRECTLY FROM THE SOURCES OF THE MENTIONED UNIVERSITIES AND STUDY PROGRAMS OR OTHER THIRD PARTY INFORMATION.

1.4. Other obligations of the user

1.4.1. The user agree not to:

  1. restrict or inhibit any other user from using the Service, including, without limitation, by means of "hacking" or otherwise impairing any portion of the App;

  2. use the App or contents provided through or via the App to engage in any act of fraud, misrepresentation or any unethical behaviour;

  3. create more than one account;

  4. express or imply that any statements the user make are endorsed by us;

  5. transmit (i) any content or information that is unlawful, fraudulent, threatening, abusive, libellous, defamatory, obscene or otherwise objectionable or inappropriate, or infringes MyGU’s or any third party's intellectual property rights or other rights; (ii) any material, non-public information about companies without the authorization to do so; (iii) any trade secrets, including of third parties; or (iv) any advertisement, solicitation, chain letters, pyramid schemes, investment opportunities or other unsolicited commercial communication (except if and as otherwise expressly permitted by MyGU in writing prior to an such communication);

  6. engage in spamming or flooding or transmitting any software or other materials that contain any viruses, worms, trojan horses, defects, date bombs, time bombs or other items of a destructive nature;

  7. modify, adapt, sub-license, translate, sell, reverse engineer, decompile or disassemble any part of the Service or contents provided through the Service;

  8. remove any copyright, trademark or other proprietary rights notices contained in the Service or contents provided through the Service; or

  9. "frame" or "mirror" any part of the Service without MyGU’s prior written authorization or use any robot, spider, site search/retrieval application or other manual or automatic device or process to retrieve, index, "data mine" or in any way reproduce or circumvent the navigational structure or presentation of the Service or contents provided through the Service.

1.4.2. While using the Service and any content or data provided through the Service, the user agrees to comply with all applicable laws, rules and regulations.

1.4.3. MyGU reserves the right to expel users and prevent their further access to the MyGermanUniversity App for violating this Agreement or violating any applicable laws and regulations. MyGermanUniversity may immediately terminate the user's use of and access to the MyGermanUniversity App, including to the user's personal account within the Service, at MyGU’s sole discretion, without giving notice or providing an explanation.IN NO EVENT SHALL MyGU, ITS AFFILIATES OR ITS PARTNERS BE LIABLE (DIRECTLY OR INDIRECTLY) FOR ANY LOSSES OR DAMAGES WHATSOEVER ARISING OUT OF OR RELATING TO the user's USE OF THE SERVICE IN THE ABOVE MANNER (I.E. IN A WAY THAT VIOLATES THIS AGREEMENT OR ANY APPLICABLE LAWS AND REGULATIONS) OR THE TERMINATION OF the user's USE OF AND ACCESS TO THE MyGermanUniversity APP.

1.5. The User’s responsibility for the mobility process 

MyGU wants to draw the user's attention to the fact that the endeavour of studying abroad, e.g. in Germany, as an international student is a very complex and personal decision which can be challenging sometimes and has no success guarantee. Hence, MyGU recommends using various sources and methods to plan the different steps of this process and not rely on the information provided by MyGU.

CONSEQUENTLY, MYGU EXCLUDES ANY REPRESENTATION OR WARRANTY RELATED TO ANY INFORMATION PROVIDED VIA THE APP. MYGU SHALL NOT BE LIABLE FOR ANY KIND OF DAMAGES, INCLUDING ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL OR PUNITIVE DAMAGES, ARISING OUT OF (BUT NOT LIMITED TO) the user's CHOICE OF A UNIVERSITY AND/OR STUDY PROGRAMME OR UNFULFILLED EXPECTATIONS TOWARDS A UNIVERSITY, A STUDY PROGRAM OR THE MOBILITY PROCESS AS A WHOLE AND ANY FORM OF COMPENSATION IS EXPRESSLY EXCLUDED.

1.6. Proprietary rights

1.6.1. MyGU owns and retains all proprietary rights in the App, and in all content, study program information, trademarks, logos, designs, trade names, service marks and other intellectual property rights related thereto.

1.6.2. The App contains the copyrighted material, including but not limited to trademarks, logos, designs and source codes and other proprietary information of the Company and its licensors. the user agree to not copy, modify, transmit, create any derivative works from, make use of or reproduce in any way any copyrighted material, trademarks, trade names, service marks, or other intellectual property or proprietary information accessible through or via the App, without first obtaining MyGU’s prior written consent or, if such property is not owned by MyGU, the owner of such intellectual property or proprietary rights. the user agree to not remove, obscure or otherwise alter any proprietary notices appearing on any content, including copyright, trademark and other intellectual property notices.

1.6.3. By posting creative suggestions, ideas, notes, concepts, information or other materials to any area of the App, the user grant to MyGU a worldwide, non-exclusive, sublicensable (through multiple tiers), assignable, royalty-free, perpetual, irrevocable right to use, reproduce, distribute (through multiple tiers), create derivative works of, publicly perform, publicly display, digitally perform, make, have made, sell, offer for sale and import such submissions or content in any media now known or hereafter developed, for any purpose whatsoever, without compensation to the provider of the submissions. None of the user's submissions will be subject to any obligation, whether of confidentiality, attribution or otherwise, on part of MyGU and MyGU will not be liable for any use or disclosure.

1.7. Advertising and notifications

1.7.1. MyGU may use the user's email for updates and tips on MyGU‘s products and services. the user also allows German universities and other service providers for international students to contact the user via us. the user can unsubscribe from these notifications at any time in the user's notification preferences.

1.7.2. All notifications from MyGU to its users will be directed per email to the email address provided in the registration process or updated by the respective user from time to time in accordance with section above or any other means of communication to which the user have provided us access. Through the MyGermanUniversity App, MyGU may also send the user notifications. If the user no longer wish to receive notifications, the user may disable this function directly in the App.

 

2. MyGU Academy (Online-Courses)

As an additional service, MyGU offers the user online courses to prepare for a study visit to Germany (e.g. Bachelor's or Master's studies, state examination, language courses). 

2.1.Structure and content of the courses

Scope of the courses

The courses are aimed at students (mainly from abroad) and directly prepare them for the following professional or study purposes: 

  • the application for an undergraduate degree (Bachelor, Staatsexamen)

  • the application for further studies (Master)

  • Admission tests and selection interviews in the context of university applications (e.g. TestAS, HAM-Nat, TMS, GMAT)

  • application for study scholarships and grants (e.g. DAAD, Begabtenförderungswerke)

as well as

  • general preparation for studies (especially examinations within the framework of studies) 

 

Teaching staff

Courses are taught by lecturers who are qualified to teach and are specially trained by MyGU for this purpose. In exceptional cases, external lecturers may also teach part of the courses. The course instructor as well as the team of instructors is named in the respective course description. However, MyGU is free to change the leaders and teachers. There is no claim for the course to be taught by a specific instructor. 

Requirements for participation

In principle, the courses are open to all those who are interested in studying at a German university themselves, who wish to apply themselves, or who have already been admitted to a course of study. In exceptional cases, the courses can also be booked by those who do not wish to apply themselves, e.g. parents or relatives or professional student advisors. However, participation is then subject to approval by MyGU.

The technical requirements for participation are that the customer has Internet access, an Internet-enabled computer (laptop, tablet, etc.) and a webcam with microphone. Participants are generally required to actively participate, i.e. the webcam and microphone must be operational and switched on. If a customer refuses to actively participate in the seminars, MyGU is free to exclude him from participation and provide him with the recording of the seminars as a substitute.

In addition, the participants are required to give their consent that 

the meetings be recorded and made available as a video recording to all course participants (including those who did not attend the particular meeting)

that personal and personally identifiable information shared during the course will be kept confidential and will not be shared with anyone outside of the course, either verbally or in writing.

Course Format

All courses are offered exclusively as online group courses. The minimum number of participants, if any, is indicated in the course description. For each course, the beginning and end dates and number of sessions are indicated in the course description. 

The seminar sessions take place as live meetings via a video conference provider (e.g. ZOOM) on the dates specified in the course description. Afterwards, participants will receive a video recording so that they can follow up on the session and work on the respective homework assignment. If a participant misses one or more seminar sessions, he or she has the option of booking an alternative seminar date on the same topic free of charge. 

In addition to the live seminars, Q&A sessions are also offered on a regular basis, especially for the debriefing of homework assignments. 

 

In addition to the live meetings, further materials (texts, tools, video-on-demand) can be made available. 

 

Curriculum

All courses have a fixed curriculum consisting of self-contained modules. A module is divided into an online course (seminar) and associated assignments and materials. The following modules are exemplary: 

 

  • How do I check whether I meet the admission requirements for studying in Germany?

  • How do I find the right university / study program?

  • How do I apply for a study place via uni-assist / directly at the university?

  • How do I write a resume for a university application?

  • How do I write a letter of motivation for a university application / a scholarship application? 

  • How does the application for a study visa / study applicant visa work?

  • Which scholarship programs are suitable for me?

  • Ùm which bureaucratic and practical issues do I have to take care of after arriving in Germany?  

 

Certificate

Provided the participant attends all sessions (or views the recordings) and completes all homework assignments, he or she will receive a certificate of active participation. This certificate has primarily symbolic value and is not connected with any recognition as an examination achievement or additional qualification. 

2.2. reservation of liability

MyGU and its teaching staff are fully informed and qualified and keep their information on study visits to Germany and related topics up to date. However, despite their experience, they cannot predict or even promise any specific success of the user's application to a university in Germany. The decision on admission to a university is always made by third parties, i.e. the universities or their representatives.

2.3. cancellation and course cancellation/postponement

2.3.1.MyGU grants the customer, beyond the 14-day period provided by the statutory right of withdrawal for consumers, the possibility to cancel the booked course free of charge until the end of the 2nd day of the seminar.  The date of the 2nd session varies depending on the course duration and is indicated in the seminar schedule. In case of later cancellation, there is no claim for reimbursement of the course fee.

2.3.2. MyGU has the right to cancel the course for immediate reasons (e.g. illness of the instructor) or if the required minimum number of participants does not materialize. Unless another number is mentioned, the minimum number of participants is 10 people. If MyGU has to cancel or reschedule a course or seminar date, MyGU may set an alternative date for the customer within a period of 45 days. If no alternative date is offered within this period, the customer has the right to be refunded the course fee for the cancelled part. 

2.3.3. MyGU reserves the right to exclude individuals from the course, e.g. if they provide untrue information about their identity or their participation in the course is contrary to the legitimate interests of the course provider. In this case, there is no right to participate in the course or compensation beyond the refund of the course fees. 

 

2.4. property rights and copyright

2.4.1.All contents of the Academy, in particular the courses, as well as components thereof are subject to industrial property rights and are protected by copyright. MyGU is the exclusive owner of all copyrights or the owner of corresponding exclusive rights of use to all works used. This includes, but is not limited to, all images, videos, films and texts. Use of these works is not permitted without the express consent of the Provider, which must in any case be in writing.

2.4.2.Prerequisite for the participation and use of the courses, regardless of whether the user uses the courses himself, is that MyGU grants the user a simple transferable right to the courses specified in the contract, limited exclusively to the respective booking, and thus to use them solely within the framework of these GTC. The user is not permitted to transfer and/or make available the urse or components thereof to unauthorized third parties, to enable public access, to edit (for example, to remove the MyGU logo) and/or to use and/or exploit in any other way than agreed. The right of use shall generally expire after one year, unless a separate period of use has been agreed between the parties electronically or in writing.

 

2.4.3.In the event that the user violates the aforementioned provision, he/she indemnifies MyGU from all justified claims of third parties due to such a violation. MyGU reserves the right to take appropriate measures itself to defend itself against claims of third parties, as well as to claim damages, including reasonable costs incurred in this connection, insofar as these are not reimbursed by third parties (e.g. legal protection insurance), and to assert other justified claims of its own against the user.

 

2.4.4.By posting creative proposals, ideas, notes, concepts, information or other materials in any area in the context of Academy courses, the user grants MyGU a worldwide, non-exclusive, sub-licensable (over several levels), assignable, royalty-free, perpetual and irrevocable right to use, reproduce, distribute (through multiple tiers), create derivative works, publicly perform, publicly display, digitally perform, manufacture, have manufactured, sell, offer for sale, and import, in any media now known or hereafter developed, for any purpose, without compensation to the provider of the Submissions. No Submissions by the User shall be subject to any obligation of MyGU, whether of confidentiality, attribution or otherwise, and MyGU shall not be liable for any use or disclosure.
