Important note: The English version of these Terms & Conditions is provided as a non-binding service translation. The German version alone is binding.
Part A - General provisions
Version 3.0 (May 3, 2025)
Note: The following provisions govern the basic relationship between MyGU GmbH (brand "MyGermanUniversity", hereinafter "MyGU") and the users of the platform. Product or module-specific provisions are contained in Parts B - C and take precedence over these General Provisions in the event of a conflict.
§ 1 Scope of application and contractual partners
- These General Terms and Conditions ("GTC") apply to all free online services, content and functions offered by MyGU GmbH ("MyGU"), Steinstr. 5-7, 20095 Hamburg, Germany, e-mail: [email protected] (Hamburg Local Court, HRB 160978), under the brand "MyGermanUniversity" on www.mygermanuniversity.com ("Platform").
- Deviating or conflicting contractual conditions of the user shall only become part of the contract if MyGU expressly agrees to their validity in text form (§ 126b BGB). Silence does not constitute consent.
- Supplementary conditions for individual modules (Parts B - C) and separate service descriptions become part of the contract when they are booked.
- The German version of these GTC is solely binding. The English version is provided exclusively as a non-binding service translation.
§ 2 Definitions of terms
For the purposes of these GTC:
- "User": any natural or legal person who registers on the Platform or otherwise accesses content.
- "Students" or "prospective students": consumers who are looking for information about study opportunities in Germany.
- "University": state or state-recognized university or other educational institution whose degree programs MyGU lists in the "StudyFinder".
- "Premium profile": an entry of a university in StudyFinder that is highlighted and marked as advertising.
- "Third-party providers": external service providers (e.g. blocked account providers) to whose services MyGU links or refers.
- "Webinars": online events conducted live via Zoom or similar tools by MyGU or partners, including recordings.
§ 3 Services provided by MyGU
- MyGU operates an information and mediation platform that includes the following free services in particular:
- Provision of the "StudyFinder" with search and filter function for over 24,000 degree programs;
- Conducting live webinars (Section 14) and providing webinar recordings in the user account;
- Provision of editorial content (e.g. blog articles, checklists) and the MyGU Academy.
- Paid services are aimed exclusively at universities. No paid products or subscriptions are currently offered to end users.
- MyGU reserves the right to adjust or discontinue free services at its reasonable discretion (Section 315 BGB), provided that this does not permanently impair the core functions of the platform.
- The user is not entitled to uninterrupted access to all content at any time, unless this is required by law (see § 327e BGB).
§ 4 Registration and user account
- Free registration is required for certain functions (e.g. unlimited access to StudyFinder, display of application deadlines, favorites list). Registration takes place via a double opt-in procedure; the contract for the use of the platform is concluded upon confirmation of the activation link.
- The user undertakes to provide all information requested during registration truthfully and completely and to keep it up to date during the term of the contract.
- The user may only create one user account and may not make the access data accessible to third parties. MyGU is entitled to block suspicious multiple accounts.
- MyGU processes personal data exclusively in accordance with the Privacy Policy. No further consent is obtained in these GTC.
- Obligation to update (§ 327f BGB): MyGU shall ensure that the platform retains the contractually agreed functionality during the term of the contract and that security-relevant updates are provided. The user is obliged to install any updates provided to him/her without delay.
§ 5 Technical availability and maintenance
- MyGU guarantees platform availability of at least 95% per calendar year. Maintenance (max. 4 h/week) and force majeure are excluded.
- In the event of significant disruptions, MyGU shall inform the user appropriately and remedy the disruption within a reasonable period of time.
- MyGU operates a "notice-and-action" mechanism within the meaning of Art. 16 DSA. Unlawful content can be reported by email to [email protected]. The report must include the URL of the content, legal grounds and contact details.
- MyGU automatically confirms receipt and checks the notification within a reasonable period of time.
§ 6 Obligations and prohibited uses
- The user undertakes not to use the platform for purposes contrary to the law or the contract, in particular not to
- post or distribute content that violates applicable law;
- bypass technical protection measures or decompile source code;
- use automated scripts (crawlers, bots), unless this has been expressly authorized by MyGU.
- In the event of serious violations (e.g. copyright infringements, attacks on IT security), MyGU is entitled to block the user account without notice and, if necessary, to assert claims for damages.
§ 7 Intellectual property and license of use
- All contents of the platform (texts, graphics, database entries, videos, webinars) are protected by copyright or database rights. MyGU or its licensors retain all rights.
- MyGU grants the registered user a simple, non-transferable license, limited to the contractual use, to use the platform and its contents for exclusively personal purposes for the duration of the contract.
- Commercial exploitation (e.g. aggregation, resale of database content) is prohibited. Violations may be prosecuted under civil and criminal law.
§ 8 Liability and warranty
- MyGU is liable without limitation for intent and gross negligence as well as for damages resulting from injury to life, limb or health.
- In the event of slight negligence, MyGU shall only be liable for the breach of a material contractual obligation ("cardinal obligation"); in this case, liability shall be limited to the foreseeable damage typical of the contract.
- Liability under the Product Liability Act and under Sections 327d, 327m, 327u BGB remains unaffected.
- MyGU assumes no liability for the accuracy, completeness and timeliness of information provided by MyGU itself (e.g. study program data) or by third parties (e.g. partner webinars). This does not apply in the case of express individual agreement or fraudulent misrepresentation.
§ 9 Amendment of these GTC
- MyGU reserves the right to amend these GTC insofar as
- this is necessary due to a change in the law, supreme court rulings or regulatory requirements or
- functional extensions of the platform or new products make an adjustment necessary and the changes are reasonable taking into account the interests of the user.
- MyGU will notify the user of the planned changes in text form at least six weeks before they are scheduled to come into effect ("notification of change"). The user may object to the changes within this period.
- If the user does not object or continues to use the platform after the deadline has expired, this shall be deemed as consent to the changes (fictitious consent). MyGU will specifically point this out to the user in the notification of change.
- In the event of a timely objection, MyGU may terminate the contractual relationship with a notice period of two weeks.
§ 10 Choice of law, place of jurisdiction and dispute resolution
- The law of the Federal Republic of Germany shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). In the case of contracts with consumers from the EU, mandatory consumer protection regulations of their country of residence remain unaffected (Art. 6 Rome I Regulation).
- The place of jurisdiction for merchants, legal entities under public law or special funds under public law is Hamburg. For consumers, the statutory place of jurisdiction shall apply.
- MyGU is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG).

§ 11 Platform use and service description
- MyGU provides the public website and all sub-domains and mobile web views free of charge. It is financed through advertising and affiliate revenues (see § 15).
- Use is permitted exclusively for private, non-commercial purposes. Automated mass selection (scraping, crawling) without the prior written consent of MyGU is prohibited.
- Personalized functions (saving favorites, personalization of information such as tuition fees or application deadlines, webinar dashboard) require registration in accordance with § 4. Personal data is processed in accordance with the privacy policy.
- MyGU reserves the right to change or discontinue free content at any time, provided that this does not result in the loss of essential contractual services for registered users (Section 327e (2) BGB).
§ 12 StudyFinder database
- The StudyFinder enables the research-based display of more than 24,000 degree programs at German universities using filter and search functions.
- A distinction is made between basic profiles (unadvertised degree programs) and premium profiles (advertised degree programs marked as advertising). Premium profiles are algorithmically prioritized and visually highlighted.
- The information on the degree programs is researched and edited by MyGU. MyGU assumes no liability for its accuracy, completeness and topicality (§ 8 para. 4) and does not provide individual study advice.
- The display of a study program does not constitute a contractual relationship between the user and the university. Only the procedure of the respective university applies for admission.
- Any further commercial use or systematic selection of the database is prohibited (§ 7 para. 3).
§ 13 MyGU Academy (online courses)
- The MyGU Academy offers free self-study courses (video lessons) to prepare for studying in Germany.
- Access is via the user account; there is no entitlement to the permanent retention of individual courses in the portfolio.
- Course material may contain third-party content protected by copyright. Duplication or public reproduction is only permitted within the scope of the legal restrictions.
- MyGU gives no assurance that successful completion of a course will lead to admission to a university.
§ 14 Webinars (live & recorded)
- MyGU conducts over 150 free live webinars per year via Zoom or comparable tools.
- General webinars (e.g. visa, scholarships, uni-assist) are hosted exclusively by MyGU.
- Subject webinars present study programs; speakers can be German universities (premium or basic profile) or occasionally external partners.
- Participation requires prior registration; access links may not be passed on to third parties.
- Technical requirements (internet connection, current browser, zoom client) are the responsibility of the user. MyGU is not liable for connection interruptions beyond its control.
- MyGU is authorized to record webinars and make them available in the user account as "on-demand recordings". By participating, the user grants permission for their name and chat contributions to be visible in the recording; the camera image and microphone are deactivated by default.
- Links to partner webinars (e.g. Fintiba) are provided via external links. The partner is solely responsible for registration, content and implementation (§ 15).
- If a webinar is canceled, MyGU will offer an alternative date or refer to a recording; there are no further claims, except in cases of intent or gross negligence.
§ 15 Affiliate links and third-party offers
- MyGU advertises selected third-party services (including blocked accounts and health insurance) and receives affiliate commissions for these.
- The current list of affiliate partnerships can be viewed in the disclaimer.
- Contracts for these third-party offers are concluded exclusively between the user and the third-party provider. MyGU assumes no responsibility for the execution of the contract, prices or scope of services.
- MyGU uses partner links, tracking parameters or cookies to determine commissions, provided the user has not objected to their use (see Privacy Policy).
- The listing of a third-party offer does not affect the independence of the editorial content of MyGU.
§ Section 16 Right of withdrawal and consumer information
- There is no statutory right of withdrawal in accordance with Section 312g BGB for the free digital services currently offered.
- If MyGU introduces paid digital content or services in the future, MyGU will provide the consumer with withdrawal instructions in accordance with Art. 246a § 1 EGBGB and a sample withdrawal form before the contract is concluded. The withdrawal period is 14 days from the conclusion of the contract.
- Information in accordance with Section 312j (3) BGB ("order subject to payment") will be provided in a highlighted manner in the event of a future checkout subject to a charge.

Part C - Final provisions

§ 17 Transfer of rights and obligations
- Rights and obligations of MyGU can be transferred to a company affiliated with MyGU (§§ 15 ff. AktG) or a purchaser of the business with a notice period of two weeks, provided that this does not impair the fulfillment of the contract. In this case, the user has an extraordinary right of termination within four weeks of notification.
- Users may only assign or transfer their rights and obligations under this contract to third parties with the prior express consent of MyGU in text form (Section 126b BGB).
§ 18 Force majeure
- Neither party shall be liable for the non-performance of its obligations if and to the extent that such non-performance is due to events beyond its reasonable control (e.g. natural disasters, war, terrorism, pandemics, labor disputes, power or internet outages).
- The affected party shall inform the other party immediately of the occurrence and expected duration of a force majeure event. The contractual obligations shall be suspended for the duration of the disruption.
- If the force majeure event lasts longer than 60 calendar days, either party is entitled to terminate the contract in text form without notice with regard to the services affected by the event.
§ Section 19 Severability clause, text form and order of precedence
- Should any provision of these GTC be or become invalid or unenforceable in whole or in part, the validity of the remaining provisions shall remain unaffected. The parties shall replace the invalid or unenforceable provision with a valid provision that comes closest to the economic purpose of the invalid provision.
- Amendments or additions to these GTC must be made in text form (Section 126b BGB). This also applies to the revocation of this text form requirement.
- In the event of a contradiction between these GTC and the individual service description, the individual agreement shall take precedence.
- These final provisions apply equally to all parts A - B. Insofar as more specific provisions are made in Part A (e.g. choice of law, place of jurisdiction, amendment clause), these shall take precedence.
